These Terms of Service ("Terms") govern your access to and use of the SNS ClockedIn platform ("the Platform") provided by SNS Tech Pty Ltd (ABN: [COMPANY ABN]) ("SNS Tech", "we", "us").

By registering for or using the Platform you agree to be bound by these Terms.

1. Definitions

  • Platform — the SNS ClockedIn SaaS application, including the web dashboard, mobile app, and API.
  • Subscriber — the organisation (company, partnership, or sole trader) that subscribes to the Platform.
  • User — an individual granted access to the Platform by a Subscriber.
  • Data — all personal and business information uploaded to or generated within the Platform.

2. Account registration

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the security of your credentials and for all activity under your account.

3. Permitted use

You may use the Platform solely for your own lawful HR, attendance, and payroll management purposes. You must not:

  • Violate any applicable law or regulation, including the Fair Work Act 2009, Privacy Act 1988, or taxation legislation.
  • Attempt to gain unauthorised access to any part of the Platform or another subscriber's data.
  • Use the Platform to transmit harmful, fraudulent, or unsolicited communications.
  • Reverse-engineer, decompile, or create derivative works from the Platform.

4. Data ownership and responsibility

You (the Subscriber) retain ownership of all Data uploaded to the Platform. You are responsible for:

  • Ensuring you have lawful authority to upload and process personal information, including obtaining employee consent where required.
  • Complying with the Privacy Act 1988 and the Australian Privacy Principles in your use of the Platform.
  • Maintaining the accuracy of Data.

SNS Tech processes Data on your behalf as a data processor under applicable Australian privacy law.

5. Compliance obligations

The Platform provides tools to assist with compliance (e.g. STP reporting, Fair Work records, superannuation). You are ultimately responsible for your compliance with all applicable laws. SNS Tech does not provide legal, tax, or accounting advice.

6. Fees and payment

Subscription fees are payable in advance as described in the applicable subscription plan. We may suspend or terminate access for non-payment after reasonable notice.

7. Data security

We maintain reasonable technical and organisational security measures as described in our Privacy Policy. You agree to promptly notify us at security@snsclockedin.com.au of any suspected unauthorised access.

8. Data retention and deletion

We retain your Data for the minimum period required by law (see Privacy Policy §8). On subscription termination, you may request export of your Data within 30 days. After 30 days post-termination we will securely delete Data subject to retention obligations.

9. Availability and maintenance

We aim for 99.5% monthly uptime. Scheduled maintenance will be notified at least 48 hours in advance. We are not liable for downtime caused by events outside our reasonable control.

10. Limitation of liability

To the maximum extent permitted by law, SNS Tech's total liability to you for any claim arising under these Terms is limited to the subscription fees paid by you in the 12 months preceding the claim. We are not liable for indirect, consequential, or incidental losses.

Nothing in these Terms limits liability for personal injury, fraud, or any matter that cannot be excluded under Australian consumer law.

11. Intellectual property

The Platform, including all software, documentation, and content, is the intellectual property of SNS Tech. No licence to this intellectual property is granted beyond what is necessary to use the Platform.

12. Termination

Either party may terminate the subscription by providing 30 days' written notice. We may suspend or terminate immediately for material breach, including non-payment or unlawful use.

13. Governing law

These Terms are governed by the laws of New South Wales, Australia. Any disputes are subject to the exclusive jurisdiction of the courts of New South Wales.

14. Changes to these Terms

We will provide at least 30 days' notice of material changes via email or in-Platform notification. Continued use after the effective date constitutes acceptance. If you do not agree to changes, you may terminate your subscription before the effective date.
